Jonathan concentrates in the areas of commercial
litigation, construction law & litigation and First Amendment law. Prior to forming the firm, Jonathan was a
partner in Alston & Bird, LLP’s Construction Group where he practiced
exclusively in construction law. He has over fifteen years’ experience in
many aspects and types of commercial and construction litigation, mediation and
arbitration. He has handled numerous construction industry disputes
including various types of breach of contract claims, lien claims, defective
construction claims, defective construction product claims, water intrusion
litigation, mold claims and payment and performance bond claims.
Jonathan has tried many cases, both as jury and non-jury trials,
over his career. In addition, he has substantial experience in many forms
of alternative dispute resolution, successfully mediating over 300 disputes.
He has appeared before arbitral forums such as the American Arbitration
Association and the International Chamber of Commerce’s International Court of
Arbitration. Jonathan has won arbitration awards for his clients as large
as nearly $8,000,000.
Jonathan also has substantial experience in a wide variety of
commercial disputes. He has represented
lenders in actions to enforce creditor’s rights, condemnees in condemnation
actions, both landlords and tenants in commercial lease disputes and dispossessory
actions, as well as property managers and developers in breach of contract and
business torts of various natures. He
recently obtained a defense verdict on behalf of a real estate developer facing
damages claims in excess of $1,000,000 involving multiple claims including
fraud, conversion, securities fraud, conspiracy and breach of contract. The jury returned a defense verdict on all eight
counts after a four day jury trial.
In addition to his litigation and dispute resolution experience,
Jonathan continues to negotiate construction contracts and development
agreements for various developers, general contractors and subcontractors on
projects ranging in size from smaller expansions to those with development
budgets in excess of $100 million.
Jonathan has counseled numerous construction industry clients in
drafting and negotiating all forms of agreements for construction projects
utilizing nearly every form of project delivery system. He has assisted clients in negotiating
contracts for use on projects such as office buildings, international
industrial plants, multi-family high rise and garden style developments,
hotels, church buildings and university housing developments. He is counsel to one of the fastest emerging
university housing development companies in the southeast on multiple student
housing projects totaling over $100,000,000 in overall development costs. He is counsel for a new sports complex development
group currently negotiating design and construction management agreements for a
project whose design and construction budget exceeds $125,000,000.
Jonathan received his J.D. degree, cum laude, in 1994 from the University of Georgia and his B.A., magna cum laude, in 1991 from Wofford College, where he was elected as a member of Phi Beta Kappa. He is admitted to practice before the state courts of Georgia and South Carolina, the U.S. District Court for the Northern District of Georgia and the U.S. District Court for the District of South Carolina as well as the United States Court of Appeals for the Fourth Circuit.
Jonathan and Kim, his wife of 17 years, have seven children and are members of The Church of the Apostles. Jonathan serves as the Chairman of the Board of Directors of the University of Georgia Christian Campus Fellowship. He is a member of the Board of Trustees for Dominion Christian Schools. He is the Chief Legal Officer for Faith First Georgia, a student scholarship organization dedicated to providing educational choice to the parents of Georgia. He is actively involved with The Church of the Apostles, serving as an usher, elementary Sunday school teacher and an actor in the Children’s Ministry Drama Team.
In 2006, Mr. Crumly was selected as a Georgia Super Lawyer Rising Star by Atlanta Magazine/Law and Politics Magazine in the annual list of top lawyers in the state of Georgia. Jonathan has lectured frequently on construction issues for such groups as the American Bar Association, CMAA, Lorman, National Business Institute, CLE International and the State Bar of Georgia (ICLE), and has published an extensive number of articles dealing with a wide variety of construction law topics.
